A Privacy Notice sets out how your
business handles personal information.
When you collect personal data from
an individual who it relates to, you must actively provide privacy
information to them. You can meet this requirement by putting the
information on your website by way of a Privacy Notice (also
sometimes called a Privacy Policy). You must make an individual
aware of the Privacy Notice and give them an easy way to access
it.
The UK GDPR sets out the requirements
for controllers of personal data in respect of what needs to be
included in a Privacy Notice. It is important to carefully consider
what personal data you collect from individuals, on what legal
bases you collect the personal data and how the personal data will
be used. This should all be expressly and accurately captured in
the Privacy Notice.
A Privacy Notice is not a contract.
It is an external policy which explains how a business collects and
handles personal data. A Privacy Notice should be relevant,
up-to-date and easy to understand.
Note that if the Privacy Notice is to
be used on a mobile application to be available on the Apple App
Store, Apple requires the Privacy Notice to be very tailored (not
general and broad) as to the personal data collected, how the
personal data is used and who it is disclosed to.
