An injunction may be granted for your business or against your business. In short, an injunction simply refers to an order which requires you to do something (a mandatory injunction) or requires you to refrain from doing something (a prohibitory injunction). There are many different types of injunctions, which are used for different purposes. Almost always, a court will order an injunction following court proceedings. This article will explain how an injunction works and some of the different types of injunctions that you may come across.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">What Do Injunctions Do?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Injunctions simply make you do something or prevent you from doing something. Some classic examples include a prohibitory injunction:&nbsp;<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">to prevent you from entering someone&#8217;s land;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">to stop the publishing of an article (for example, if the article is defamatory); or&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">in the form of a restraining order (for example, in domestic violence cases).&nbsp;<\/span><\/li>\n<\/ul>\n\n\n\n<div class=\"box box--icon box--info\">\n<p><span style=\"font-weight: 400\">It is worth keeping in mind that the courts will rarely issue a mandatory injunction.&nbsp;<\/span><\/p>\n<\/div>\n\n\n\n<p><span style=\"font-weight: 400\">Breaching an injunction can mean that you are in &#8216;<a href=\"https:\/\/legalvision.co.uk\/disputes-litigation\/contempt-of-court-uk\/\">contempt of court<\/a>&#8216;. Being in contempt of court can mean that your county court punishes you through a term of imprisonment of up to two years or through an unlimited fine. The punishment will usually vary with the reason for which the court gave the injunction.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Injunctions in a Business Context<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">There are usually two key requirements f<\/span>or the court <span style=\"font-weight: 400\">to grant an <a href=\"https:\/\/legalvision.co.uk\/commercial-contracts\/american-cyanamid-test-injunction\/\">injunction<\/a>: <\/span><\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">you must have a right that has been infringed (or is about to be infringed); and <\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">monetary awards (damages) must not be an adequate \u2018remedy&#8217; for your right being infringed.&nbsp;<\/span><\/li>\n<\/ol>\n\n\n\n<p><span style=\"font-weight: 400\">To get an injunction, you will have to <a href=\"https:\/\/legalvision.co.uk\/disputes-litigation\/commercial-case-goes-to-court-of-appeal\/\">appeal to a court<\/a>. An injunction is a discretionary remedy (sometimes called an equitable remedy) t<\/span>hat the court <span style=\"font-weight: 400\">grants to you. This means that you must convince the court that there are good reasons that you should have an injunction to protect your legal rights, instead of damages.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">An injunction can come in many forms. One form which you may come across is an &#8216;<a href=\"https:\/\/legalvision.co.uk\/disputes-litigation\/what-is-an-interim-injunction\/\">interim injunction<\/a>&#8216; (<\/span>or<span style=\"font-weight: 400\"> a temporary injunction). An interim injunction is where the c<\/span>ourt grants the <span style=\"font-weight: 400\">injunction until t<\/span>hey can make <span style=\"font-weight: 400\">a proper judgement. In this way, it is a temporary remedy that prevents a party from doing something before the court can assess the best course of action.&nbsp;<\/span><\/p>\n\n\n\n<div class=\"box box--icon box--info\">\n<p><span style=\"font-weight: 400\">Alternatively, an injunction may be permanent.
