While seasoned employers may be well-versed in the former, the latter might raise a few eyebrows. Though interrelated, these documents serve distinct purposes in the employer-employee relationship. This article aims to demystify both concepts, shedding light on their key differences and why understanding them is vital.<\/p>\n\n\n\n<p>Employers commonly integrate the written statement of particulars with the employment contract to create a single consolidated document. The written particulars which are statutory requirements under section 1 of the <em>Employment Rights Act 1996<\/em>, include: job title, remuneration, working hours, and notice periods. This approach enhances administrative efficiency and ensures compliance with statutory requirements while having all of the necessary information in one centralised place.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">What is an Employment Contract?<\/span><\/h2>\n\n\n\n<p>An <a href=\"https:\/\/legalvision.co.uk\/employment\/importance-employment-contracts\/\">employment contract<\/a> is a legal agreement between you and your employee regarding their employment. It sets out your employee\u2019s rights and duties in the workplace, as well as your corresponding obligations as an employer.<\/p>\n\n\n\n<p>An employment contract begins as soon as new employees or workers accept the job you offer them. Additionally, while the contract does not have to be in writing, it must lay out your employee\u2019s:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>conditions of employment;<\/li>\n\n\n\n<li><a href=\"https:\/\/legalvision.co.uk\/employment\/employment-rights\/\">employment rights<\/a>;<\/li>\n\n\n\n<li>responsibilities in their employment; and\u00a0<\/li>\n\n\n\n<li>their employment duties.<\/li>\n<\/ul>\n\n\n\n<div class=\"box box--icon box--info\">\n<p><span style=\"font-weight: 400\">The employment contract binds you and your employee until the contract terminates or you agree to alter its terms.<\/span><\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">What is a Written Statement of Particulars?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">A written statement of particulars lays out the main conditions of your employee or worker\u2019s employment with you. In this sense, a statement of particulars is evidence of the employment contract. <\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">The written statement of particulars consists of two documents:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">the \u2018principal statement\u2019, which is the primary document; and<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">the wider written statement.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">The law states that you must give your employees and workers a written statement of particulars.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">The Principal Statement<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">You must give your employee or worker their principal statement on or before their first day of employment with you, regardless of the number of hours they work.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">The principal statement must contain the following information:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">your name and address and your employee or worker\u2019s name;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">the job title, description and start date, and, if the employee is already employed by you, the date of their previous job;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">the rate of pay;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">days and hours of work, including any variance and requirements to work Sundays, nights or overtime;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">place(s) of work, including any potential for relocation;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">the duration of their job with you, including any specific end date;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">any probationary period length and conditions;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">any mandatory training, including details of who pays for this; and<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">other benefits such as, for example, lunch vouchers.<\/span><\/li>\n<\/ul>\n\n\n\n<div class=\"box box--icon box--info\">\n<p><span style=\"font-weight: 400\">There is also further information that you must include if your employee or worker will be working outside of the UK for at least one month. Here, you must include their length of time out of the UK and any currency they are paid in. style=\"font-weight: 400\">non-mandatory training which you provide;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">disciplinary and grievance procedures; and<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">collective agreements, which are agreements you may have with your employee\u2019s representatives that let you negotiate any terms and conditions of their employment with
