With the COVID-19 pandemic taking over much of our everyday lives, most of us are aware of its impact on mental well-being.<\/span>\u00a0<a href=\"https:\/\/www.gov.uk\/government\/speeches\/mental-health-in-the-workplace\"><span style=\"font-weight: 400;\">According to the UK Government<\/span><\/a><span style=\"font-weight: 400;\">, employers are faced with costs of between \u00a333 billion and \u00a342 billion each year due to poor mental health.<\/span><\/p>\n<p><span style=\"font-weight: 400;\"> Therefore, it is essential to be aware that your employees may be suffering from mental health problems and support them. Your employees\u2019 mental health may be due to mental illnesses that their job contributes towards, and you can support them with. On the other hand, they may not be workplace mental health issues, but you can still support them at work as their employer. <\/span><span style=\"font-weight: 400;\">This article will explain how to support employees with mental health problems. It will explain your obligation as an employer towards employees with poor mental health and how you can help them in the workplace.<\/span><\/p>\n<h2>What Are Mental Health Problems?<\/h2>\n<p><span style=\"font-weight: 400;\">A person\u2019s mental health consists of how they think, feel and behave.\u00a0<\/span><span style=\"font-weight: 400;\">There is a wide range of mental health illnesses, and some are more well known than others. For example, you may have heard about depression, anxiety and stress. However, you may be less familiar with mental health conditions such as bipolar disorder and schizophrenia. Whilst stress or work-related stress is not a medical condition, it can significantly impact a person&#8217;s mental wellbeing. In the UK, the number of people who will experience mental health problems at some stage in their lives is one in four<\/span><span style=\"font-weight: 400;\">.<\/span><\/p>\n<h2>What is an Employer&#8217;s Obligation in Terms of Mental Health Problems?<\/h2>\n<p><span style=\"font-weight: 400;\">As an employer, you are under a legal duty to support your employees in terms of their <a href=\"https:\/\/legalvision.co.uk\/employment\/workplace-safety-assessments\/\">health, safety and wellbeing<\/a>. This is your \u2018duty of care\u2019. This means that you must:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">ensure a safe working environment;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">protect your staff from <a href=\"https:\/\/legalvision.co.uk\/employment\/employment-discrimination\/\">discrimination<\/a>; and<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">provide your staff with complete risk assessments in the workplace.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Your obligation as an employer to protect your staff from discrimination includes a duty towards them regarding their mental health. This is because mental health problems can be a disability, regardless of whether or not your employee\u2019s symptoms are present all the time.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If all of the following relate to your employees\u2019 mental health problems, it can legally be a disability if the mental health problem:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">has a \u2018substantial adverse effect\u2019 on your employee\u2019s life, which means that may they struggle to focus on their work or take longer than others to complete it;<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">will last a minimum of 12 months; or<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">impacts your employee\u2019s ability to complete normal daily activities such as, for example, interacting with colleagues.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">If your employee\u2019s mental health problem is a disability, then you have a legal duty:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">not to discriminate them concerning the illness; and<\/span><\/li>\n<li style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">to make reasonable adjustments in the workplace to support them with
