However, there is a legal minimum wage you must comply with. This is the <a href=\"https:\/\/www.gov.uk\/national-minimum-wage-rates\">National Minimum Wage<\/a> (NMW) or National Living Wage (NLW) for those aged 23 and over. If you do not pay the NMW or NLW where you are required to, <a href=\"https:\/\/www.gov.uk\/government\/organisations\/hm-revenue-customs\">Her Majesty\u2019s Revenue and Customs (HMRC)<\/a> may require you to pay the arrears, and you may be issued a fine. Additionally, your employee can ask you to produce their pay records to establish whether you have paid them the NMW or NLW. If you fail to produce such records within 14 days of their request, they can initiate a tribunal claim against you. To help you avoid such a dispute, this article will explain:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>what the NMW and NLW rates are;<\/li>\n\n\n\n<li>which employees are entitled to the NMW and NLW; and<\/li>\n\n\n\n<li>how to calculate the minimum hourly rate and the records you should keep.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What Do the NMW and NLW Mean?<\/h2>\n\n\n\n<p>Under UK employment law, most workers are entitled to minimum hourly pay. However, the actual hourly pay varies according to the worker\u2019s age and whether or not they are an apprentice.&nbsp;<\/p>\n\n\n\n<p>The NMW and NLW rates are reviewed every year. The rates per hour from April 2024 to March 2025 are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u00a36.40 for apprentices;<\/li>\n\n\n\n<li>\u00a36.40 for those under 18;<\/li>\n\n\n\n<li>\u00a38.60 for 18 to 20-year-olds;<\/li>\n\n\n\n<li>\u00a311.44 for 21 years and over.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Who Should Receive the NMW and NLW?<\/h2>\n\n\n\n<p><a href=\"https:\/\/legalvision.co.uk\/employment\/employment-statuses\/\">Workers of school leaving age<\/a> and above are entitled to the NMW. The school leaving age is usually 16 years old.&nbsp;On the other hand, from April 2024, workers who are 21 years old or over are entitled to receive the NLW. If you state a lower wage amount than the current rates on a worker\u2019s employment contract, the payment stated will not be legally binding.<\/p>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p><span style=\"font-weight: 400\">A worker is someone who:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">has a contract or arrangement to work;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">you reward with money or a benefit for completing the work;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">has a limited right to allow the work they do for you to be subcontracted;<\/span><\/li>\n<li style=\"font-weight: 400\"><span style=\"font-weight: 400\">must receive work from you as their employer for the length of the contract or arrangement; and<\/span><\/li>\n<li style=\"font-weight: 400\">is not a customer or client in its capacity as a <a href=\"https:\/\/legalvision.co.uk\/corporations\/limited-vs-unlimited-company\/\">limited company<\/a>.<\/li>\n<\/ul>\n<\/div>\n\n\n\n<p>The law obliges you to pay workers the NMW or NLW even where they are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>part-time workers;<\/li>\n\n\n\n<li>agency workers;<\/li>\n\n\n\n<li>workers on probation;<\/li>\n\n\n\n<li><a href=\"https:\/\/legalvision.co.uk\/employment\/employer-responsibilities-workers-disability\/\">disabled workers<\/a>; or<\/li>\n\n\n\n<li><a href=\"https:\/\/legalvision.co.uk\/employment\/how-to-hire-foreign-workers\/\">foreign workers<\/a>.<\/li>\n<\/ul>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>If you find out that you
