This can involve depositing the criminal earnings into a bank account or using complex, multi-layered transactions to hide the origin, ownership, or control of the funds.<\/p>\n\n\n\n<p>Money laundering can pose a significant threat to UK businesses and the wider economy. For example, criminals may:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>use businesses to move or hide illegal funds;\u00a0<\/li>\n\n\n\n<li>involve professional advisers in laundering schemes; or\u00a0<\/li>\n\n\n\n<li>set up complex arrangements to conceal the true owners of criminal assets.\u00a0<\/li>\n<\/ul>\n\n\n\n<div  class=\"box box--icon box--warning\">\n    <p>Money laundering can also fuel further crime, and, as such, the law treats money laundering as a serious offence.<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">The Legal Rules on Money Laundering<\/h2>\n\n\n\n<p>In the UK, there are important laws that govern money laundering.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><em>The Proceeds of Crime Act 2002<\/em><strong>\u00a0<\/strong><\/h3>\n\n\n\n<p>This act establishes key money laundering offences and a framework for reporting suspicious activity. It is broad and applies to businesses and individuals, as well as imposing additional obligations (supported by criminal sanctions) on those operating in the regulated sector.\u00a0<\/p>\n\n\n\n<p>This law regards it a criminal offence to engage in money laundering via directly handling the proceeds of crimes. Offences can include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>concealing, disguising, converting or transferring criminal property;\u00a0<\/li>\n\n\n\n<li>entering into arrangements that facilitate the retention;\u00a0<\/li>\n\n\n\n<li>using or controlling criminal proceeds;\u00a0<\/li>\n\n\n\n<li>acquiring, using or possessing criminal property;\u00a0<\/li>\n\n\n\n<li>failing to report suspicions of money laundering (in regulated businesses); or\u00a0<\/li>\n\n\n\n<li>tipping off a person who is the subject of a money laundering investigation.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>The principal money laundering offences carry a maximum penalty of up to 14 years\u2019 imprisonment and an unlimited fine. <\/p>\n\n\n\n<div  class=\"box box--icon box--warning\">\n    <p>Organisations, even if they&#8217;re not part of the regulated sector, can still commit serious money laundering offences if they know or suspect that property is linked to crime.<\/p>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><em>The Money Laundering Regulations 2017<\/em><strong>\u00a0<\/strong><\/h3>\n\n\n\n<p>This law governs how certain organisations must conduct business and transactional work to prevent money laundering. These regulations apply to \u2018relevant persons\u2019 acting in the course of business in the UK, including:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>financial institutions;\u00a0<\/li>\n\n\n\n<li>auditors;\u00a0<\/li>\n\n\n\n<li>insolvency practitioners;\u00a0<\/li>\n\n\n\n<li>legal and accountancy professionals;\u00a0<\/li>\n\n\n\n<li>trust or company service providers;\u00a0<\/li>\n\n\n\n<li>estate and letting agents;\u00a0<\/li>\n\n\n\n<li>high-value dealers;\u00a0<\/li>\n\n\n\n<li>casinos; and\u00a0<\/li>\n\n\n\n<li>art market participants.\u00a0<\/li>\n<\/ul>\n\n\n\n<p>Businesses covered by these regulations must follow specific and detailed AML obligations, such as:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>carry out risk assessments;\u00a0<\/li>\n\n\n\n<li>maintain appropriate policies, controls and procedures;\u00a0<\/li>\n\n\n\n<li>provide anti-money laundering training to staff;\u00a0<\/li>\n\n\n\n<li>conduct customer due diligence (including identifying beneficial ownership); and<\/li>\n\n\n\n<li>retain records.\u00a0<\/li>\n<\/ul>\n\n\n\n<div  class=\"box box--icon box--warning\">\n    <p>If businesses fail to comply with these requirements, regulators can impose fines, and serious breaches may lead to criminal charges.<\/p>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><strong><em>Sanctions and Anti-Money Laundering Act 2018<\/em><\/strong><\/h3>\n\n\n\n<p>The rules in the <em>Sanctions and Anti-Money Laundering Act 2018<\/em> apply to all businesses and individuals.
