It also grants employees certain rights, such as the right to t<\/span>ake <span style=\"font-weight: 400\">time off work and the right t<\/span>o fair treatment<span style=\"font-weight: 400\">. As an employer, you must ensure you are aware of the rights o<\/span>f <span style=\"font-weight: 400\">your employees. Not honouring your employees&#8217; rights may lead to poor morale and relationships, leading to an employment tribunal against you.\u00a0This article will explain what employment rights are and give an overview of some of the leading employment rights you owe your employees.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">What Are Employment Rights?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Employment rights are rights the law grants employees regarding their employment. They can be:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"font-weight: 400\">rights given to employees, such as leave; and\u00a0<\/span><\/li><li><span style=\"font-weight: 400\">protections to ensure employees are f<\/span>ree from<span style=\"font-weight: 400\"> <\/span><a href=\"https:\/\/legalvision.co.uk\/employment\/employment-discrimination\/\"><span style=\"font-weight: 400\">discrimina<\/span>tion <span style=\"font-weight: 400\">or harassment<\/span><\/a><span style=\"font-weight: 400\"> at work.<\/span><\/li><\/ul>\n\n\n\n<div class=\"box box--icon box--info\">\n<p><span style=\"font-weight: 400\">Not all employees are automatically entitled to all employment rights. For example, it can depend on how long you have continuously employed an employee.<\/span><\/p>\n<\/div>\n\n\n\n<p><span style=\"font-weight: 400\">There are many different employment rights. This article does not list all the rights but explains some of the primary rights employees <\/span>have<span style=\"font-weight: 400\">. A brief description relating to each is outlined.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">National Minimum Wage<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">The <a href=\"https:\/\/legalvision.co.uk\/employment\/national-minimum-wage\/\">National Minimum Wage<\/a> is the minimum hourly wage your employees have a right to receive. This will depend on their age and whether or not they are still an apprentice.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Maximum Working Hours and Minimum Rest Breaks<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Unless your employees have agreed otherwise, they have a right not to work more than an average of 48 hours per week, and if they are<\/span> between<span style=\"font-weight: 400\"> 16 and 18 years old, 40 hours.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Where your employees are over 18 years of age, they have a right to:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">weekly rest;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">daily rest; and<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">rest breaks while at work.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Weekly rest grants your employees the right to either 48 hours interrupted break from work over two weeks or 24 hours over one week. Daily rest grants your employees 11 hours of rest between shifts. Rest breaks at work for employees should be 20 minutes where they have worked six hours.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Holiday Leave<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Employees have the right to <a href=\"https:\/\/legalvision.co.uk\/employment\/holiday-leave-entitlements\/\">paid holiday leave each year<\/a>. The legal requirement is 5.6 weeks. The length of a week will be the same as the length of your employee\u2019s typical working week.<\/span><\/p>\n\n\n\n<div class=\"box box--icon box--info\">\n<p><span style=\"font-weight: 400\">You must pay the holiday leave at the employee&#8217;s average pay rate. The rate should also take into account any parts of pay which relates to their work. For example, commission.&nbsp;<\/span><\/p>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Statutory Sick Pay<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">When your employees are unwell, they<\/span> have the right<span style=\"font-weight: 400\"> to a minimum amount of pay whilst not working. This is \u00a396.35 per week. Your employees have a right to this for up to 28 weeks.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Rights Related to Being a Parent or a Carer<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Your employees who are parents or carers have the right to take time off work for this role. The table below explains different types of leave.&nbsp;<\/span><\/p>\n\n\n\n<figure class=\"wp-block-table\"><table><tbody><tr><td>\n<p><span style=\"font-weight: 400\">Maternity leave and pay<\/span><\/p>\n<\/td><td>\n<p><span style=\"font-weight: 400\">Employees are entitled to 52 weeks of maternity leave. However, 39 weeks of this must be paid for at a statutory amount where your employees qualify for this. Maternity leave and pay can be shared between two parents. Where this is done it is referred to as shared parental leave and pay.<\/span><\/p>\n<\/td><\/tr><tr><td>\n<p><span style=\"font-weight: 400\">Paternity leave and pay<\/span><\/p>\n<\/td><td>\n<p><span style=\"font-weight: 400\">Your employees may be entitled to two weeks worth of paternity leave and statutory pay.&nbsp;<\/span><\/p>\n<\/td><\/tr><tr><td>\n<p><span style=\"font-weight: 400\">Adoption leave and pay<\/span><\/p>\n<\/td><td>\n<p><span style=\"font-weight: 400\">Your employee or the leading adopter of another child is entitled to statutory adoption leave and may be entitled to statutory adoption pay.<\/span><\/p>\n<\/td><\/tr><tr><td>\n<p><span style=\"font-weight: 400\">Parental leave, including parental bereavement leave.<\/span><\/p>\n<\/td><td>\n<p><span style=\"font-weight: 400\">If your employee has parental responsibility for a child they can take up to 18 weeks of unpaid leave per child to look after them.<\/span><\/p>\n<\/td><\/tr><\/tbody><\/table><\/figure>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Unlawful Discrimination<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Your employees have the right not to be unlawfully discriminated against. The following are some of the areas <\/span>where the law protects<span style=\"font-weight: 400\"> your employees f<\/span>rom discrimination<span style=\"font-weight: 400\">:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">race;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">gender;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">nationality;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">religion or belief;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">sexual orientation;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">pregnancy;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">maternity;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">age;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">disability;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">fixed-term contract; and<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">part-time worker.<\/span><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Unfair Dismissal<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">As an employer, you should be aware that the law protects your employees from <a href=\"https:\/\/legalvision.co.uk\/employment\/constructive-dismissal\/\">unfair dismissals<\/a>. This applies to employees who have worked continuously for at least two years.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Flexible Working<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Your employees may have the right to request a flexible working arrangement with you. However, they need to have at least 26 weeks of continuous service with you and only have the right to make one request per 12 months.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Redundancy<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">If you need to make your employees redundant, you should be aware that they have rights relating to this process, including statutory redundancy pay.
