When an employee chooses to leave, they do so by handing in their resignation. Sometimes, however, an employee may have a change of heart after submitting their notice. If your employee resigned and then withdrew their resignation, this results in a retracted resignation, which can leave you unsure of how to respond.<\/p>\n\n\n\n<p>This article will explain resignations, how your employee may go about it, and your legal position as an employer if your employee withdraws their resignation. Resigning can also be termed:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">quitting the job; or<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">handing in the notice.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Your employee may resign at any point during their employment with you.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">How Should My Employees Hand in Their Resignation?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">If your employee decides to resign, they should typically give you notice of this. Their contract of employment with you should state how long that notice period is. If their contract does not specify their notice period, i<\/span>f<span style=\"font-weight: 400\"> they have worked for you for one month or more, they must legally give you a minimum of one week\u2019s notice. This requirement does not increase where your employee has worked for you for longer than one month.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">If you have a <a href=\"https:\/\/www.gov.uk\/handling-staff-resignations\">resignation process<\/a> for your business in any <a href=\"https:\/\/legalvision.co.uk\/employment\/employment-policies\/\">procedural or policy document<\/a>, your employee should follow this. You should state a process and include<\/span> <span style=\"font-weight: 400\">a clause in your employee&#8217;s employment contract requiring notice of resignation to be in writing.<\/span> This will<span style=\"font-weight: 400\"> save any confusion over resignation.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Where you do not have a clause in the contract or a procedure in place, your employee will likely r<\/span>esign in writing anyway<span style=\"font-weight: 400\">. However, there is nothing that requires them to do this. If your employee&#8217;s employment contract states that notice must be handed to you in w<\/span>riting<span style=\"font-weight: 400\">, they should follow this when handing in their resignation.<\/span><\/p>\n\n\n\n<div class=\"box box--icon box--info\">\n<p><span style=\"font-weight: 400\">However, if your employee\u2019s resignation details a grievance issue, you should look into this.<\/span><\/p>\n<\/div>\n\n\n\n<p>If your employee resigns in the heat of the moment, you, as an employer, are responsible for advising them to think about their request.
