These standards are the National Living Wage (for those over 21) and the National Minimum Wage (for those under 21). Before April 2024, there used to be a 23+ age bracket for the highest minimum wage.  This has now been reduced to all those over 21.&nbsp;<\/p>\n\n\n\n<div  class=\"box box--icon box--star\">\n    <p>To keep up to date with the changing National Minimum and Living wage rates, see <a href=\"https:\/\/www.gov.uk\/national-minimum-wage-rates\">here<\/a>.<\/p>\n<\/div>\n\n\n\n<p>Employees are legally entitled to be paid at least the national minimum or living wage, depending on their age.&nbsp;<\/p>\n\n\n\n<p>Some <a href=\"https:\/\/legalvision.co.uk\/employment\/employment-status\/\">examples of workers<\/a> who will also be entitled to the correct minimum wage are:\u00a0<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>part-time workers,<\/li>\n\n\n\n<li>casual labourers or agency workers,&nbsp;<\/li>\n\n\n\n<li>apprentices, trainees and workers on probation.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What are the Most Common Situations Where Employers Fall Below Minimum Wage Requirements?<\/h2>\n\n\n\n<h3 class=\"wp-block-heading\">Overtime<\/h3>\n\n\n\n<p>Employees who <a href=\"https:\/\/legalvision.co.uk\/employment\/overtime-rates\/\">work overtime<\/a> can commonly earn less than the minimum wage if their hourly or yearly salary is closer to the current minimum wage requirements. Therefore, ensuring that overtime does not reduce an employee\u2019s salary below the minimum wage is essential.\u00a0<\/p>\n\n\n\n<p>Those on an hourly wage should continue to be paid their basic pay rate for any additional hours worked. This is unless you have provided a contractual right or it\u2019s a common practice in your business to provide a premium rate for extra hours.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Deductions and Payments<\/h3>\n\n\n\n<p>Sometimes, employers overpay their employees.  Or, at the end of their employment, an employee may take too much holiday or fail to return company equipment. A business may deduct money from an employee&#8217;s wage to cover this in these instances.&nbsp;<\/p>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>When calculating any deductions or payments owed to the company to be taken from an employee&#8217;s wage, it is important to ensure that they are not falling below the national minimum wage, as this could result in an unlawful deduction of wages which the employee could pursue in the employment tribunal.<\/p>\n<\/div>\n\n\n\n<p>A way around this issue would be to pay any final outstanding wages owed to the employee and then send a separate letter pursuing the amounts owed unless the deduction would not lower the employee&#8217;s wage below the minimum wage.
