However, if you have strong evidence that your employee has been fraudulent or negligent, and you would not have hired them but for the representation, you have two options. You may dismiss your employee with or without notice.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Dismissal Without Notice<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Dismissal without notice is a risky course of action for you as an employer. This option should be limited to where your employee\u2019s dishonesty is a severe repudiatory breach.&nbsp;<\/p>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>Overall, you should seek legal advice and exercise caution if considering this option. If you do not have sufficient grounds for dismissal without notice, your employee may bring a <a href=\"https:\/\/legalvision.co.uk\/employment\/unfair-wrongful-dismissal\/\">claim of unfair dismissal<\/a> against you.<\/p>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Dismissal With Notice<\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">If the breach is not repudiatory, you should take the option to dismiss your employee with notice. This option also allows you to part with your employee smoothly.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Steps Should You Take Before Dismissing an Employee for Misrepresentation?<\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Before dismissing an employee for misrepresentation, you must follow a fair procedure. Failing to do so could expose your business to an unfair dismissal claim. Even where an employee has clearly misrepresented themselves, you should:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>investigate the misrepresentation thoroughly before taking any action;<\/li>\n\n\n\n<li>invite the employee to a formal disciplinary meeting and give them reasonable notice;<\/li>\n\n\n\n<li>allow the employee to be accompanied by a colleague or trade union representative at the meeting; and<\/li>\n\n\n\n<li>give the employee a fair opportunity to explain their conduct before you make a decision.<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Employees with at least two years of continuous service have the right to bring an unfair dismissal claim in an Employment Tribunal.
