Avoiding litigation in the commercial court and determining your business disagreement by choosing an alternative dispute resolution (ADR) method is wise. <a href=\"https:\/\/legalvision.co.uk\/disputes-litigation\/arbitration-dispute-resolution-legal-process-implications\/\">One ADR method you may decide on is arbitration<\/a>. This is where an expert third party listens to the arguments between you and the other party and makes a temporarily binding decision. If you choose arbitration for your commercial dispute, you should know the English <em>Arbitration Act 1996<\/em> rules. One is Section 68, which relates to challenging the arbitral award. This article will, therefore, explain the legal guidelines for Section 68 of the <em>Arbitration Act<\/em>.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is the Purpose of Section 68 of the Arbitration Act?<\/h2>\n\n\n\n<p>Section 68 of the English <a href=\"https:\/\/www.legislation.gov.uk\/ukpga\/1996\/23\/contents\"><em>Arbitration Act 1996<\/em><\/a> allows a party to arbitration to challenge the arbitration award on the grounds of:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>a serious irregularity occurring; and&nbsp;<\/li>\n\n\n\n<li>that this will or has caused the party challenging the award a \u2018substantial injustice\u2019.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Both of the above must be present to succeed. This is the dual requirement of Section 68 of the Act.&nbsp;<\/p>\n\n\n\n<p>The serious irregularity must affect either the:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>tribunal;<\/li>\n\n\n\n<li>proceedings; or&nbsp;<\/li>\n\n\n\n<li>award.<\/li>\n<\/ul>\n\n\n\n<p>It must also fall under one of the areas for serious irregularity as outlined in the Act.<\/p>\n\n\n\n<p>Section 68 of the <em>Arbitration Act<\/em> applies to all <a href=\"https:\/\/legalvision.co.uk\/disputes-litigation\/arbitration-process-commercial-dispute\/\">arbitration proceedings<\/a>. This means that if parties to arbitration cannot agree, the provision will not apply.\u00a0<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What are the Legal Rules Concerning Section 68 of the Arbitration Act?\u00a0<\/h2>\n\n\n\n<p>The <em>Arbitration Act<\/em> details many rules relating to Section 68, and we look at some of these below. If you wish to challenge an arbitral award, you should get advice from a disputes solicitor.\u00a0\u00a0<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Meaning of Award<\/h3>\n\n\n\n<p>An essential legal rule to be aware of in Section 68 of the Act is the award&#8217;s meaning. The Act does not define this, but previous arbitral challenges have defined it. Therefore, it means more than a decision referred to as an \u2018arbitral award\u2019 and can include decisions not referred to as this.&nbsp;<\/p>\n\n\n\n<p>The court determines that a decision can be challenged through Section 68 by looking at the substance of the decision. If the tribunal does not decide on a substantive claim, the court is unlikely to consider the decision one that can be challenged. For example, if you try to challenge a tribunal&#8217;s decision not to order security costs and strike out a claim, this has been known not to be allowed under Section 68 of the Act.&nbsp;<\/p>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>Section 68 is used for failings in the Arbitration process. It is not concerned with whether the arbitral decision is correct. Instead, it concerns the arbitrator&#8217;s conduct in the arbitration. However, this is where the conduct is so bad it is only fair in the eyes of justice that there is a way to correct it.<\/p>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Time Limit<\/h3>\n\n\n\n<p>There is a strict time limit if you wish to challenge your arbitral award on a serious irregularity. In addition, you must make your challenge as soon as you become aware that a severe irregularity has occurred. These state that before you challenge the award through this provision, you must have exhausted other avenues to challenge the award. This includes, for example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>any arbitral process of review;<\/li>\n\n\n\n<li>any arbitral process of appeal; and<\/li>\n\n\n\n<li>a <a href=\"https:\/\/legalvision.co.uk\/disputes-litigation\/use-court-commercial-arbitration-process\/\">tribunal\u2019s powers to change the award or issue an additional
