This article explores consent under the UK GDPR and how a consent form can help your business comply with these regulations.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a Lawful Basis for Processing?<\/h2>\n\n\n\n<p>Under the <a href=\"https:\/\/legalvision.co.uk\/data-privacy-it\/how-does-gdpr-affect-my-business\/\">UK GDPR<\/a>, you must identify and document a lawful basis before collecting personal data.&nbsp;&nbsp;<\/p>\n\n\n\n<p>There are six lawful bases which have the meaning set out below:&nbsp;<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>consent:<\/strong> this is where the individual gives clear permission for you to process their data;<\/li>\n\n\n\n<li><strong>contract:<\/strong> this is where the processing is necessary to fulfil a contract with the individual;<\/li>\n\n\n\n<li><strong>legal obligation:<\/strong> in this case, the processing is required to comply with the law;<\/li>\n\n\n\n<li><strong>vital interests:<\/strong> here, processing is necessary to protect someone&#8217;s life;<\/li>\n\n\n\n<li><strong>public task:<\/strong> here, processing is needed for tasks in the public interest or official functions; and<\/li>\n\n\n\n<li><strong>legitimate interests:<\/strong> In this case, processing serves your legitimate interests, provided these do not override the individual&#8217;s rights.<\/li>\n<\/ul>\n\n\n\n<p>Your business must carefully review and consider the appropriate lawful basis to process personal data. However, consent is not always the best choice and can be challenging to obtain in practice.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is Consent and Explicit Consent?<\/h2>\n\n\n\n<p>Implied consent is invalid under the UK GDPR rules, and your business must show that you obtained informed consent. <a href=\"https:\/\/legalvision.co.uk\/data-privacy-it\/consent-uk-gdpr-rules\/\">Under the UK GDPR rules, consent must be \u2018freely given, specific, informed, and unambiguous\u2019<\/a>.
