In such cases, you must be aware of any undertakings to the court that either you or the third party may need to provide. Understanding these undertakings can help you avoid a court order. This article will outline the legal guidelines and requirements for signing an undertaking to the court.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is an Undertaking to a Court?&nbsp;<\/h2>\n\n\n\n<p>An undertaking to a court is a standard part of legal proceedings. It is where you make a legal promise to confirm that you will do something or refrain from doing it. Therefore, it is a voluntary procedure and an alternative to a court making an order on an individual to carry out an action or prevent them from doing something. It could include, for example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>promising to be in court on a specific date and time; or<\/li>\n\n\n\n<li>promising not to take action in <a href=\"https:\/\/legalvision.co.uk\/disputes-litigation\/going-to-court\/\">court proceedings<\/a> before a particular date.<\/li>\n<\/ul>\n\n\n\n<p>If you break an undertaking to the court, they can enforce it. The court can also:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>fine you;<\/li>\n\n\n\n<li>imprison you; or<\/li>\n\n\n\n<li>have your assets seized.<\/li>\n<\/ul>\n\n\n\n<p>However, the Court of Appeal rules that whether an undertaking has been given or not to a court is a question of fact in each specific instance. Also, only the court can approve, amend, or revoke an undertaking.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">How Do I Give an Undertaking to a Court?&nbsp;&nbsp;<\/h2>\n\n\n\n<p>If your business is involved in court litigation, you must seek legal advice from a litigation solicitor. class=\"wp-block-list\">\n<li>detail the promise made, including the date this occurred; and<\/li>\n<\/ul>\n\n\n\n<ul class=\"wp-block-list\">\n<li><a href=\"https:\/\/legalvision.co.uk\/disputes-litigation\/witness-statements-commercial-dispute\/\">sign a statement describing what you understand<\/a>, what undertaking you have given and the
