You may also have to deal with allegations about your employees or even you as the employer. This may include allegations about victimisation in the workplace. It is crucial that you understand the law on this and how to deal with accusations to avoid a claim at an employment tribunal. This article explains victimisation in the workplace and how you can prevent an allegation of victimisation.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Is Victimisation?<\/h2>\n\n\n\n<p>Victimisation is a type of discrimination in the workplace. It is where a person suffers a detriment because of their involvement in a complaint about harassment or discrimination. Harassment and discrimination are illegal in the workplace where they concern:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>race;<\/li>\n\n\n\n<li>sex;<\/li>\n\n\n\n<li>disability;<\/li>\n\n\n\n<li><a href=\"https:\/\/legalvision.co.uk\/employment\/sick-leave-pregnancy\/\">pregnancy and maternity<\/a>;<\/li>\n\n\n\n<li>religion or belief;<\/li>\n\n\n\n<li>age<\/li>\n\n\n\n<li>sexual orientation;<\/li>\n\n\n\n<li>gender reassignment; or<\/li>\n\n\n\n<li>marriage and civil partnership.<\/li>\n<\/ul>\n\n\n\n<p>A detriment for victimisation could be either or both of the below:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>treating the person worse than you previously treated them; and<\/li>\n\n\n\n<li>making the person\u2019s situation worse.<\/li>\n<\/ul>\n\n\n\n<p>However, <a href=\"https:\/\/legalvision.co.uk\/employment\/responding-to-bullying-harassment\/\">victimisation is not the same as bullying<\/a>. Being treated less favourably through victimisation can include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>leaving a person out;<\/li>\n\n\n\n<li>preventing a person from doing something; or&nbsp;<\/li>\n\n\n\n<li>calling someone a troublemaker.<\/li>\n<\/ul>\n\n\n\n<div  class=\"box box--icon box--star\">\n    <p>For example, suppose you advertise an internal position, and one of your employees who applies for it is acting as a witness for another employee&#8217;s disability discrimination claim against you. As a result, you decide not to give them the role because you believe they are a troublemaker. This is you victimising your employee.<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">Is Victimisation Legal?&nbsp;<\/h2>\n\n\n\n<p>As victimisation is discrimination under the <em>Equality Act 2010<\/em>, it is illegal to do it in the workplace. It is unlawful to victimise someone in the workplace where the person has carried out or intends to carry out a \u2018protected act\u2019. It is also illegal to victimise if, when doing so, you believe that your worker intends to carry out a \u2018protected act\u2019 even if they have not.<\/p>\n\n\n\n<p>A \u2018protected act\u2019 means the person has taken some action, which means they are involved in harassment or discrimination. This includes:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>making the complaint;<\/li>\n\n\n\n<li>supporting another&#8217;s person&#8217;s complaint;<\/li>\n\n\n\n<li>gathering information that could become a complaint;<\/li>\n\n\n\n<li>offering themselves as a witness for another person&#8217;s complaint; or<\/li>\n\n\n\n<li>providing evidence for a complaint or voicing something that fails
