A <a href=\"https:\/\/legalvision.co.uk\/commercial-lease-property\/agreement-for-lease\/\">lease agreement<\/a> is a legally binding contract between a commercial landlord and a tenant.  Both parties will sign this at the start of the lease, and it binds them throughout the lease term.  The lease agreement contains all the rules of the commercial lease.  Typical lease terms include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the lease end date;<\/li>\n\n\n\n<li>the rent amount\u00a0and due dates;<\/li>\n\n\n\n<li>repair and maintenance obligations for both parties;<\/li>\n\n\n\n<li>any rent review clause to review the rental amount periodically;<\/li>\n\n\n\n<li>any break clause to allow either party to terminate the lease before the lease end date; and<\/li>\n\n\n\n<li>any assignment clause to allow a commercial tenant to pass the lease to a third party.&nbsp;<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What is a Protected Lease?<\/h2>\n\n\n\n<p>A protected commercial lease enjoys <a href=\"https:\/\/legalvision.co.uk\/commercial-lease-property\/security-of-tenure-advantages-disadvantages\/\">security of tenure<\/a>.  Security of tenure is a statutory protection from the Landlord and Tenant Act 1954.  It allows a lease to automatically renew with the same lease terms at the end of its term.  A tenant does not need to request the renewal; the lease will automatically continue.<\/p>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>However, a tenant can request the lease renew on better terms than the current one.\u00a0 A landlord does not have to accept these terms, and where they are in dispute, a court may decide on them.<\/p>\n<\/div>\n\n\n\n<p>Although the security of tenure is a statutory right, there are limited legal grounds in which a commercial landlord can refuse to honour the lease renewal.  These include, for example:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>if the landlord wants to demolish the property;<\/li>\n\n\n\n<li>where the landlord intends to occupy the property; Contracted-out refers to the fact that the lease does not enjoy security of tenure, and a commercial landlord and tenant agree to contact out the relevant provisions in the Landlord and Tenant Act.
