This is a legally binding contract that will detail all the lease terms, including:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the length of the lease;<\/li>\n\n\n\n<li>the agreed rental amount;<\/li>\n\n\n\n<li>permitted use or uses of the lease;<\/li>\n\n\n\n<li>any rent review mechanism in the lease;<\/li>\n\n\n\n<li>existence of a break clause;<\/li>\n\n\n\n<li>alienation covenants;<\/li>\n\n\n\n<li>repair and maintenance obligations for either party;&nbsp;<\/li>\n\n\n\n<li>any contracted-out clause; and<\/li>\n\n\n\n<li><a href=\"https:\/\/legalvision.co.uk\/commercial-lease-property\/terminate-commercial-lease\/\">termination rights<\/a>.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>A commercial lease also grants the right to the commercial tenant of exclusivity in the commercial lease, often referred to as the right to exclusive possession.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Right to Exclusivity<\/h2>\n\n\n\n<p>A commercial lease grants a tenant the right to occupy the property with the landlord\u2019s consent. Where a tenant has a commercial lease, the rights to exclusivity means they have contractual rights and a proprietary interest in the property or land they occupy. This right is also the right to exclusive possession.&nbsp;<\/p>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>The right to exclusive possession or exclusivity in a commercial lease does not require the commercial tenant to physically occupy the property to enjoy the right.<\/p>\n<\/div>\n\n\n\n<p>Rights to exclusive possession for a commercial tenant in the property mean they have the right to exclusively use the defined area of the property in the lease agreement during the lease term.&nbsp;<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">Exclusivity in Your Lease<\/h3>\n\n\n\n<p>In practice, the right to exclusivity or exclusive possession means that the commercial tenant enjoys total control over the property or part of it. Therefore, the tenant has specific rights over the property as though they are the actual landowner (the landlord), which include:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>sole access to their commercial premises;<\/li>\n\n\n\n<li>no obligation to share the occupation of the premises with another third party; and<\/li>\n\n\n\n<li>no obligation to allow another third party to use the premises.<\/li>\n<\/ul>\n\n\n\n<p>The rights apply to the landlord, too, who the law considers a \u2018third party\u2019. This right to restrict the landlord\u2019s access to the commercial premises is the tenant\u2019s right to quiet enjoyment. However, as each lease agreement is different, there might be situations where a landlord can enter the premises, such as to conduct inspections.
