This article will explain what the Bill is and some of the key issues for businesses to be aware of.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What Does the Online Safety Bill Seek to Achieve?<\/h2>\n\n\n\n<p>The Online Safety Bill is extremely ambitious. The Bill aims to make the UK the \u2018safest place in the world to be online\u2019 by setting out significant rules to protect both children and adults online. When passed into law, it will have a huge impact on service providers who fall within its scope. A key aim of this law is to make social media more responsible for user safety when using their platforms.<\/p>\n\n\n\n<p>In terms of who needs to comply, the Bill will govern businesses that provide online \u2018user-to-user services\u2019. For example, businesses that are suppliers of internet services that allow users to share user-generated content will be impacted by the law. Likewise, businesses that provide online search services, such as Google, will be impacted by the law.<\/p>\n\n\n\n<p>Examples of businesses that will be expected to comply with the Online Safety Bill are:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>social media platforms;&nbsp;<\/li>\n\n\n\n<li>search engines;&nbsp;<\/li>\n\n\n\n<li>gaming services;<\/li>\n\n\n\n<li>dating apps;<\/li>\n\n\n\n<li>messaging services; and<\/li>\n\n\n\n<li>online forums.<\/li>\n<\/ul>\n\n\n\n<p>The Online Safety Bill will impact several different types of businesses, from different industries and of different sizes. Further, the law will also apply to certain international businesses with UK-based users.<\/p>\n\n\n\n<p>The Bill will apply different rules to different types of service providers. These service providers will be categorised based on two key factors. Firstly, the size of their online presence. Secondly, the risks their platforms pose to UK citizens. Businesses will need to carefully consult the rules to determine what their obligations are.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Key Obligations the Online Safety Bill Imposes<\/h2>\n\n\n\n<p>Some key obligations introduced by the Online Safety Bill include the obligation to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>remove illegal content and work to prevent it from appearing in the first place;&nbsp;<\/li>\n\n\n\n<li>carry out age-verification and risk assessments and prevent children from accessing harmful content;&nbsp;<\/li>\n\n\n\n<li>give parents and children clear and accessible ways to report problems arising online; and&nbsp;<\/li>\n\n\n\n<li>make sure that the risks and dangers to children on the largest <a href=\"https:\/\/legalvision.co.uk\/regulatory-compliance\/social-media-business-benefit\/\">social media<\/a> platforms are more transparent.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Whilst the Bill tackles crucial issues around <a href=\"https:\/\/legalvision.co.uk\/data-privacy-it\/online-safety-act-compliance\/\">online safety<\/a>, its new set of rules will likely be very onerous for businesses to comply with in practice.\u00a0<\/p>\n\n\n\n<p>Failing to comply with the rules under the Bill could result in extremely severe penalties, such as fines of up to \u00a318 million or 10% of a business\u2019 annual turnover, whichever is higher. Further, failing to comply with the Bill could lead to criminal prosecution.
