The most common way to address this requirement is to issue children with a bespoke \u2018Children\u2019s Privacy Policy\u2019. This article will explain what a Children\u2019s Privacy Notice is and the key issues around preparing one.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why Do Children Need Privacy Information?<\/h2>\n\n\n\n<p>Whenever you are <a href=\"https:\/\/legalvision.co.uk\/data-privacy-it\/common-mistakes-handling-personal-data\/\">processing personal data<\/a> about children, you will need to be fully transparent about it. Your business must inform them about how you will use their personal data. \u2018Transparency\u2019 is one of the key principles under the UK GDPR.<\/p>\n\n\n\n<p>Many businesses do not realise there is a requirement to give children privacy information or that you might need a separate Children\u2019s Privacy Policy. However, this applies even though children are young. The UK Information Commissioner&#8217;s Office has issued specific guidance on collecting data from children and providing privacy information to them.<\/p>\n\n\n\n<div  class=\"box box--icon box--idea\">\n    <p>The most common way to provide transparency information is by giving children a \u2018Children\u2019s Privacy Policy\u2019 telling them how you will use their personal data.<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">What to Include?<\/h2>\n\n\n\n<p>A Children\u2019s Privacy Policy should set out various information, including but not limited to the following:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>details of your organisation\u2019s identity and <a href=\"https:\/\/legalvision.co.uk\/data-privacy-it\/need-dpo\/\">Data Protection Officer<\/a>, if applicable;<\/li>\n\n\n\n<li>your contact details;<\/li>\n\n\n\n<li>the kinds of information you collect from children;<\/li>\n\n\n\n<li>childrens\u2019 data protection rights;<\/li>\n\n\n\n<li>how your business will use personal information;<\/li>\n\n\n\n<li>how your business collects data;<\/li>\n\n\n\n<li>the rules you need to follow when processing personal data (i.e. the lawful basis you rely upon to process data of children);<\/li>\n\n\n\n<li>who you will share their information with and if it will be sent out of the UK; and<\/li>\n\n\n\n<li>how long you will keep their information.<\/li>\n<\/ul>\n\n\n\n<p>If you are not sure what information this document needs to contain, you should seek legal advice. Preparing a Children\u2019s Privacy Notice which meets the UK GDPR requirements, can be extremely difficult. Extra complications arise when the children you are collecting data from are pre-literate, or you are relying on parental consent.
