This procedure allows a commercial landlord to recover <a href=\"https:\/\/legalvision.co.uk\/commercial-lease-property\/steps-lease-dispute\/\">rent arrears<\/a> from their tenant. It is a relatively quick and efficient process for a landlord to recover missing rent, though it should not substitute open communication with your tenant.&nbsp;<\/p>\n\n\n\n<p>As a landlord, you cannot automatically conduct the CRAR process for rent arrears. Instead, specific conditions need to be in place, including that the:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>tenant is already in rent arrears;<\/li>\n\n\n\n<li>number of years must be known and exact;<\/li>\n\n\n\n<li>arrears must be at least seven days\u2019 worth of rent; and<\/li>\n\n\n\n<li>tenant must still owe the rent arrears when the actual enforcement occurs.<\/li>\n<\/ul>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>Whilst it is usually a commercial landlord who exercises the CRAR process, it is legally possible for a lender, mortgagee or court receiver to do so.<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\">How Does the CRAR Process Work?<\/h2>\n\n\n\n<p>To recover rent arrears through the CRAR process, an enforcement agent will seize the tenant\u2019s assets currently on the commercial property. They will then sell them, and the proceeds will go towards the rent arrears debt the tenant owes you. You can only receive what amounts to the rent arrears debt and no more.<\/p>\n\n\n\n<p>The specific legal process for CRAR is as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>compliance stage \u2013 the landlord sends their tenant a seven-day enforcement notice which details what the arrears are and gives the option of paying within seven days;<\/li>\n\n\n\n<li>enforcement stage \u2013 an enforcement officer seizes the tenant&#8217;s goods; and<\/li>\n\n\n\n<li>disposal stage \u2013 an enforcement officer sells the tenant\u2019s goods to recover rent for rent arrears.&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>The CRAR process only allows enforcement officers to seize the tenant\u2019s goods on the commercial premises and not other goods which may be
