Your obligations will heavily depend on the type of property you own.&nbsp;<\/p>\n\n\n\n<p>Typical duties relating to health and safety involve matters such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>installation and maintenance of any fixtures and fittings you own;<\/li>\n\n\n\n<li>maintenance of the communal&#8217;s electrical system; and<\/li>\n\n\n\n<li>compliance with gas safety responsibilities (failing to do so could result in a fine or imprisonment).&nbsp;<\/li>\n<\/ul>\n\n\n\n<p>Your lease may also detail that the ongoing maintenance and safety of the building\u2019s communal areas are your responsibility. You may also be responsible for undertaking an asbestos assessment, creating a management plan, and providing fire safety equipment. Your business tenants will often take over these management responsibilities, which the lease may refer to specifically or generally.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Repairs and Maintenance<\/h2>\n\n\n\n<p>You will often continue to be responsible for certain repairs and maintenance. These, may be set out explicitly in your lease, or may be imposed on you by other legal obligations to ensure areas are legally compliant or repaired when they are damaged, and often include areas such as:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>the foundations;<\/li>\n\n\n\n<li>flooring;<\/li>\n\n\n\n<li>the roof; and&nbsp;<\/li>\n\n\n\n<li>exterior walls.<\/li>\n<\/ul>\n\n\n\n<p>Starting from April 2023, you must maintain the property with an Energy Performance Certificate performance rating of at least E. Leasing the premises without this rating is illegal.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Building Insurance<\/h2>\n\n\n\n<p>Arranging building insurance is usually your responsibility as the commercial landlord. You will initially pay for it, but you may pass it on to your tenant as insurance rent.
