You may have other elements associated with your brand, such as the colours that you use. Therefore, you will likely wish to trade mark an aspect of your business. This article will explain the differences between registered and unregistered trade mark in the UK.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Registered Trade Marks<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">You can register your business\u2019 trade mark in the <\/span><a href=\"https:\/\/www.gov.uk\/government\/organisations\/intellectual-property-office\"><span style=\"font-weight: 400\">UK Intellectual Property Office (IPO)<\/span><\/a><span style=\"font-weight: 400\">. The mark you want to register can be a:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">word;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">sound;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">logo;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">colour; or<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">a combination of these things.&nbsp;<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">However, the brand element or business name must not be too similar to an existing registered trade mark. Also, it cannot be:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">&nbsp;offensive;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">&nbsp;misleading; or<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">descriptive of the goods you sell or the services you provide.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">Trade marks do not apply across all possible goods and services. Instead, when you make trade mark applications, you must indicate which classes of goods or services the trade marks apply. There are 45 classes, and you can <\/span><a href=\"https:\/\/www.search-uk-trade-mark-classes.service.gov.uk\/searchclasses\"><span style=\"font-weight: 400\">search the different classes<\/span><\/a><span style=\"font-weight: 400\"> easily to decide which are appropriate for your trade mark. There is no limit to the number of classes you can register your trade mark in. However, you must only register the mark in the services related to your business or the products or services you sell now or hope to within the next five years.<\/span><\/p>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>Provided no one else has registered the same or a similar mark as any unregistered trade mark you use, you can register a trade mark at any time. You can do this even if you have been using it for several years before registering.<\/p>\n<\/div>\n\n\n\n<p><span style=\"font-weight: 400\">You can show that you have registered your trade mark by using the \u2018\u24c7\u2019 symbol on your trade mark. This shows others they should not use your trade mark without your permission.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Once you have successfully obtained your registered trade mark, it lasts for ten years and is renewable every ten years, so you can potentially retain your registered trade mark indefinitely. If you want to rely on an <\/span><a href=\"https:\/\/legalvision.co.uk\/intellectual-property\/have-to-register-trade-mark\/\"><span style=\"font-weight: 400\">unregistered trade mark<\/span><\/a><span style=\"font-weight: 400\">, you need to show the following:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">proof that that mark is yours;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">that you have established a reputation associated with that mark (i.e. that customers and potential customers associate that particular brand with your company); and&nbsp;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">that someone else is using that mark which is causing harm to your business.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">For example, the most well-known case in Britain over an unregistered trade mark was the 1990 \u2018Jif Lemon\u2019 case (Reckitt &amp; Colman Products Limited v Borden Inc). This involved the packaging of Reckitt &amp; Colman\u2019s Lemon Juice product, which they sold in distinctive lemon-shaped and coloured packaging. It was a very well-known product in British households then. A competitor, Borden, started selling their own lemon juice in similar shaped and coloured packaging. However, Reckitt &amp; Colman successfully showed that Bordon had infringed their unregistered trade mark in their Jif Lemon product.<\/span><\/p>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>You can demonstrate an unregistered trade mark by using the symbol \u2018\u2122\u2019 on your brand.
