However, imagine upon doing so, you receive a trade mark objection from the <\/span><a href=\"https:\/\/www.gov.uk\/government\/organisations\/intellectual-property-office\"><span style=\"font-weight: 400\">UK Intellectual Property Office (UK IPO)<\/span><\/a><span style=\"font-weight: 400\">. This article will explain how the objection process works and your options should you end up in a position where your chosen trade mark has had an objection filed against it.<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Trade Mark Registration<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">You can only <\/span><a href=\"https:\/\/legalvision.co.uk\/intellectual-property\/register-your-trade-mark\/\"><span style=\"font-weight: 400\">register a trade mark<\/span><\/a><span style=\"font-weight: 400\"> if it meets the following criteria:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">it is unique and distinctive; and<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">is a word, sound, logo, colour, or a combination of these things.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">The following characteristics will make a trade mark invalid for registration:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">being offensive, such as using swear words;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">descriptive of the goods or services it relates to;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">being misleading such as using the word woollen when the material is something else;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">if it is a three-dimensional shape that is associated with what you sell;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">resembling a state flag or other state symbol; and<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">appearing too common or non-distinctive.<\/span><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Objections to Trade Marks<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">When registering a trade mark, you will receive an examination report from the UK Intellectual Property Office (UK IPO). If your trade mark meets the requirements for registration, they will publish it in the trade marks journal for two months. The examiner will notify you if someone else has a similar trade mark and contact that trade mark holder.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">There are two kinds of objections to trade mark applications:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"font-weight: 400\">the third-party observation;<\/span> and<\/li><li><span style=\"font-weight: 400\">opposing the trade mark.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">A third-party observation is when somebody notifies the IPO <\/span>with the belief that<span style=\"font-weight: 400\"> your trade mark is valid. This could be because your brand is not distinctive enough or too generic. An objection on absolute grounds is similar to a third-party observation.
