However, from 1 January 2021, the way you employ workers outside the UK has changed due to the Brexit transition period. Consequently, the UK immigration system must process <em>all <\/em>foreign worker applications, including workers from the European Union but not citizens of the Republic of Ireland. However, if you knowingly employ a person without immigration permission, this can lead to a prison sentence of up to two years. This article will explain:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>who qualifies as a foreign worker;<\/li><li>the importance of checking if a person can work in England; and&nbsp;<\/li><li>the criteria foreign workers must meet and sponsor licences.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What is a Foreign Worker?<\/h2>\n\n\n\n<p>A foreign worker is someone who works for you and does not have UK citizenship. A foreign worker may not wish to settle permanently in the UK. Instead, they may want to work in the UK for a certain period of time.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Checking a Person is Allowed to Work in the UK<\/h2>\n\n\n\n<p>If you consider offering someone a job, you must check if they are allowed to work in the UK. This means you must ask them to <a href=\"https:\/\/legalvision.co.uk\/employment\/right-to-work\/\">prove they can work in the UK<\/a> before you decide to employ them. If you fail to check that a person can work in the UK, you could receive a fine of up to \u00a320,000.&nbsp;<\/p>\n\n\n\n<p>However, you do not need to conduct a check where the worker:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>is from the EU, EEA or Switzerland; <\/li><li>already an employee of a UK business; and <\/li><li>has been in the UK before 1 July 2021. Generally, a foreign worker can work for you where they:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>have a job offer from an approved sponsor at the skill level required;<\/li><li>can speak English; and<\/li><li>have 70 points from a list of specific characteristics.<\/li><\/ul>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>For example, meeting a particular salary level or holding a specific qualification relevant to the job is a specific characteristic. Each holds a value of a specific number of points, and you can trade some of these characteristics.<\/p>\n<\/div>\n\n\n\n<h3 class=\"wp-block-heading\">Sponsor Licences<\/h3>\n\n\n\n<p>Not all foreign workers will require a <a href=\"https:\/\/legalvision.co.uk\/employment\/sponsor-licence-for-foreign-workers\/\">sponsor licence<\/a> to work for you. For example, you will not need one for:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>an Irish citizen;<\/li><li>a person who has indefinite leave to stay in the UK; or<\/li><li>someone who has applied to the EU Settlement Scheme and gained settled or pre-settled status.<\/li><\/ul>\n\n\n\n<p>However, many potential employees will require a sponsor licence. This includes people who come to the UK after 31 December 2020 from:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>the EU;<\/li><li>Iceland;<\/li><li>Liechtenstein;<\/li><li>Norway; and&nbsp;<\/li><li>Switzerland.<\/li><\/ul>\n\n\n\n<p>Where your employee needs a sponsor licence, you must check which type of licence you require. This depends on various factors, such as whether the person will work for you temporarily or long-term. You must apply online for your sponsorship licence and pay the relevant fee.&nbsp;<\/p>\n\n\n\n<p>You will also need to check:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>if your business is allowed to apply for a sponsor licence;<\/li><li>if the job you wish to fill is one suitable for sponsorship; and<\/li><li>who will manage the sponsorship.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Foreign Workers and Employment Contracts<\/h2>\n\n\n\n<p>When employing foreign workers, you should consider whether their <a href=\"https:\/\/legalvision.co.uk\/employment\/employment-contracts\/\">employment contract<\/a> needs adjustments.
