As an employer, you must understand the Regulations and how they affect your business. If you fail to implement them in your workplace, you could face potential legal action, such as criminal sanctions and imprisonment. To help you avoid these sanctions, this article explains the Regulations in England.\u00a0\u00a0<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">What Are the Working Time Regulations?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">The Regulations are a set of <a href=\"https:\/\/legalvision.co.uk\/employment\/rules-on-working-times\/\">legal rules<\/a> which restrict workers in terms of the number of hours they can work every week. Work hours<\/span> include <span style=\"font-weight: 400\">the time your staff complete work and any training you provide. However, work hours do not include:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">standard time travelling to and from the workplace and home;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">lunch breaks; or&nbsp;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">time spent on-call unless the on-call period arises during their workday.&nbsp;<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">The&nbsp;Regulations apply to most workers, whether they are full-time or part-time, agency or freelance workers. In saying that, the Regulations do not apply to some workers, including:&nbsp;<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"font-weight: 400\">emergency service staff when working on an emergency;<\/span><\/li><li><span style=\"font-weight: 400\">the armed forces;<\/span><\/li><li><span style=\"font-weight: 400\">the police; and<\/span><\/li><li><span style=\"font-weight: 400\">those whose working time is not measured or pre-determined such as those employed by their family.&nbsp;<\/span><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">What Do the Working Time Regulations Say?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">The main rules in the Regulations are as follows:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"font-weight: 400\">your employees must not work&nbsp;more than 48 hours per week unless they agree to work more, which is called an opt out;&nbsp;<\/span><\/li><li><span style=\"font-weight: 400\">you are obliged to allow your employees 5.6 weeks minimum time off work per year (their annual leave);&nbsp;<\/span><\/li><li><span style=\"font-weight: 400\">within 24 hours, your workers should have one consecutive hour of rest;&nbsp;<\/span><\/li><li><span style=\"font-weight: 400\">where your employees work for longer than 6 hours in a row, you must allow a <a href=\"https:\/\/legalvision.co.uk\/employment\/rest-breaks\/\">rest break<\/a> of at least 20 minutes;&nbsp;<\/span><\/li><li><span style=\"font-weight: 400\">you must allow your staff at least 11 hours of rest between each working day;&nbsp;<\/span><\/li><li><span style=\"font-weight: 400\">you must give your staff at least 1 day off work per week;&nbsp;<\/span><\/li><li><span style=\"font-weight: 400\">where you have night workers, you must ensure they do not work for more than 8 hours per day within 24 hours; and&nbsp;<\/span><\/li><li><span style=\"font-weight: 400\">where you workers are 16 and 17 years old, they must not work more than 8 hours per day and no more than 40 hours per week.<\/span><\/li><\/ul>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>You should note that the 48-hour maximum hours your staff can work per week applies overall to their time at work. This means that if your employee works two jobs, their total hours from both jobs must not exceed the maximum. Consequently, it is helpful to ask your staff to declare any second job they may have so that you can factor this in when asking them to work certain hours.<\/p>\n<\/div>\n\n\n\n<p><span style=\"font-weight: 400\">The Regulations require you to <a href=\"https:\/\/legalvision.co.uk\/employment\/rules-on-working-times\/\">keep records <\/a>of your workers to demonstrate that you are applying the Regulations correctly. For example, you should record the hours your employee worked and keep records relating to night-time workers&#8217; rules.
