A voidable contract gives you the right to end your legal relationship with the other party. This can be particularly useful if you <a href=\"https:\/\/legalvision.co.uk\/disputes-litigation\/my-business-is-in-a-dispute\/\">end up in a dispute<\/a> with another party, and wish to cancel the contract you had with them.&nbsp;<\/p>\n\n\n\n<p>This article will explain what a voidable contract is, when you may have the right to void your contract and some alternative options that may be available to you.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a Voidable Contract?<\/h2>\n\n\n\n<p>Put simply, a voidable contract is a contract that a party has the right to rescind. <a href=\"https:\/\/legalvision.co.uk\/commercial-contracts\/rescind-a-contract-uk\/\">Rescinding a contract<\/a> occurs when you put the contract aside and make it ineffective. Despite being voidable, this type of contract is still a legally valid contract which gives rise to rights and obligations.&nbsp;<\/p>\n\n\n\n<p>To rescind a contract, a person can either:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>tell the other party that they are rescinding the contract; or<\/li><li>ask a court to order rescission.&nbsp;<\/li><\/ul>\n\n\n\n<p>To be able to rescind a contract, you must do it within a reasonable period of time from when you have the right to rescind. When you rescind a contract, you will have the right to refuse further performance of your obligations. However, if you do not rescind the contract correctly, you may be taken to have affirmed the contract.<\/p>\n\n\n\n<p>Affirming a contract is where you acknowledge your right to rescind, but choose to continue to perform the contract. Choosing to affirm the contract means that you cannot then rescind it.&nbsp;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What is a Void Contract?<\/h2>\n\n\n\n<p>Importantly, a voidable contract is different from a <a href=\"https:\/\/legalvision.co.uk\/commercial-contracts\/void-contract\/\">void contract<\/a>. A void contract is a contract which was never a valid contract in the first place. This means that none of the two parties can enforce the contract using legal action. The contract also cannot transfer legal title to anyone, including an innocent third party.&nbsp;<\/p>\n\n\n\n<p>Usually, a contract might be declared void by a court during a dispute for a number of reasons.
