When you invest your company\u2019s resources (both time and financial) into an individual, you often do so with limited insight into their full potential and cultural fit. To mitigate these risks, many organisations implement probationary periods. This approach allows you to assess an employee\u2019s performance, adaptability and alignment with your company\u2019s values in real-time before committing to a long-term engagement. In this article, we will explore:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>what probationary periods are;&nbsp;<\/li>\n\n\n\n<li>how they work; and&nbsp;<\/li>\n\n\n\n<li>the potential forthcoming changes in the employment law space.<\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">What is an Employment Probationary Period?<\/span><\/h2>\n\n\n\n<p>When an employee starts working for you, you may have a probationary period in place. This allows you to test their ability to perform the job and ensure they are the right fit for your company. Many also refer to a probation period as a \u2018trial period\u2019.&nbsp;<\/p>\n\n\n\n<p>Whilst it benefits the employer, a probationary employment period can also help your employee decide if the role suits them. Evidence suggests that including a probationary period makes it more likely that the employee will be successful in the job.<\/p>\n\n\n\n<div  class=\"box box--icon box--info\">\n    <p>If you decide to have a probationary period for your employees, you must include the conditions, including the length of the probationary period, in their written contract. You must give this to your employee before or on their first day of employment.<\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Employment Rights During a Probationary Period<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">All statutory legal rights which apply to an employee also apply during their probationary period. This includes:&nbsp;<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">the requirement to make <a href=\"https:\/\/legalvision.co.uk\/employment\/employer-responsibilities-workers-disability\/\">reasonable adjustments if your employee has a disability<\/a>;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">the right not to be unlawfully discriminated against;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">receiving the <a href=\"https:\/\/www.gov.uk\/national-minimum-wage-rates\">national minimum wage<\/a>;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">statutory sick pay; and<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\"><a href=\"https:\/\/legalvision.co.uk\/employment\/leave-entitlements-england-wales\/\">maternity and paternity leave<\/a>.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">However, there are some exceptions. Notably, you can often terminate the contract on shorter notice during the probationary<\/span> period. You may also detail further contractual rights, <span style=\"font-weight: 400\">which may apply differently during a probationary period than when the probationary has ended<\/span>. For instance,<span style=\"font-weight: 400\"> employee benefits. Nonetheless, your employee\u2019s <a href=\"https:\/\/legalvision.co.uk\/employment\/express-implied-terms\/\">employment contract must state this<\/a>.<\/span><\/p>\n\n\n\n<p>That being said, there are some rights, such as ordinary unfair dismissal, that employees with less than two years of service will be unable to bring. From a commercial perspective, this has tended to mean that you could look to dismiss employees without two years of service more easily. <\/p>\n\n\n\n<div  class=\"box box--icon box--warning\">\n    <p>Under the Labour Government&#8217;s new <a href=\"https:\/\/legalvision.co.uk\/employment\/labours-new-workers-rights-bill\/\">Workers\u2019 Rights Bill<\/a>, this is set to change, and employees will gain these rights from day one. For new employees, probationary periods are usually no more than six months. You may require this if you need more time to decide whether the employee is suitable for the role.
