One to consider is a whistleblower policy in your business. <\/span>The law in the UK does not require a <span style=\"font-weight: 400\">whistleblower policy. However, it is good practice to have one.<\/span> This is because<span style=\"font-weight: 400\"> it demonstrates you promote an open environment and <\/span>encourage employees to express any concerns<span style=\"font-weight: 400\">. Where you do not treat the employee making the complaint fairly, the whistleblower could take you to an employment tribunal.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">This article will explain whistleblower policies, the importance of these and the rules relating to them. As an employer, you need to be aware of the law regarding whistleblowers should you be faced with one in your workplace<\/span>. This is <span style=\"font-weight: 400\">so you can deal with the situation correctly with as few negative repercussions as possible.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">What is a Whistleblower?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">A whistleblower in the workplace is a worker who has seen wrongdoing at work. Since it could affect other people, they report what they have seen as a whistleblowing concern.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">The wrongdoing could:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">have occurred in the past;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">be occurring at the time of reporting it; or<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">be believed to occur in the future.<\/span><\/li>\n<\/ul>\n\n\n\n<div class=\"box box--icon box--info\">\n<p><span style=\"font-weight: 400\">Rules protect most workers who are whistleblowers. These include that their act of reporting the wrongdoing due to their genuine concern should not cause the company to mistreat them, cause them to lose their job, or cause any other detrimental action.<\/span><\/p>\n<\/div>\n\n\n\n<p><span style=\"font-weight: 400\">The following are some of the potential examples of wrongdoing that could be raised as whistleblowing complaints:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\"><a href=\"https:\/\/legalvision.co.uk\/employment\/ordinary-gross-misconduct\/\">criminal acts<\/a> or other legal wrongdoing;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">concern for a person\u2019s <a href=\"https:\/\/legalvision.co.uk\/employment\/workplace-safety-assessments\/\">health and safety<\/a>;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">environmental damage; or<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">reporting the potential covering up of wrongdoing by another.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">The following are examples of complaints which when raised, are not whistleblowing:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">workplace disputes which might typically be dealt with b<\/span>y <a href=\"https:\/\/www.gov.uk\/acas\"><span style=\"font-weight: 400\">Advisory Conciliation and Arbitration Service (Acas)<\/span><\/a><span style=\"font-weight: 400\">; and<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">grievance issues.<\/span><\/li>\n<\/ul>\n\n\n\n<div class=\"box box--icon box--info\">\n<p><span style=\"font-weight: 400\">However, if any issues falling under the above two examples are in the public interest to disclose, these would count as being whistleblowing complaints.<\/span><\/p>\n<\/div>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Why Have a Whistleblowing Policy?<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">When an employee has a concern that may a<\/span>mount<span style=\"font-weight: 400\"> <\/span>to<span style=\"font-weight: 400\"> whistleblowing, <\/span>this policy will inform them<span style=\"font-weight: 400\"> to tell you as their employer. They may do this anonymously.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">An employee may raise a whistleblowing complaint regardless of whether or not the business has a whistleblowing policy in place. It is, therefore, sensible for you to have a whistleblowing policy in place.<\/span> T<span style=\"font-weight: 400\">his could detail what the employee should expect when letting you know about their whistleblowing concern.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">However, an employee <\/span>does not have<span style=\"font-weight: 400\"> to come to you with a whistleblowing complaint. They may instead take legal advice or report the complaint to a relevant prescribed body or person for the subject of the complaint.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">You may want to have a whistleblowing policy in place to:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">show your intention as an employer to take whistleblowing complaints seriously &#8211; where an employee feels that is not the case, they may go to tell another person who could be, for example, their trade union or Acas. Taking the complaint away from your business may risk damage to your reputation;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">detail your commitment to treating whistleblowers fairly. Where they have felt they have not been treated fairly, they could make a claim at an employment tribunal; and&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">enable your business to
