One such entitlement is parental leave rights. As an employer, you need to be aware of what this entails so you can avoid unwanted repercussions for your business and ensure the wellbeing of your employees.\u00a0<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">This article will outline four types of parental leave entitlements for your employees and will explain the rights associated with both.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">In England and Wales, there are four types of parental leave. These are:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">maternity leave;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">paternity leave;&nbsp;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">adoption leave; and&nbsp;<\/span><\/li><li style=\"font-weight: 400\"><span style=\"font-weight: 400\">shared parental leave.<\/span><\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">You should note that when an employee takes a form of parental leave, this does not affect their entitlement to annual leave.&nbsp;<\/span><\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Parental Leave Rights<\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Maternity Leave<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Suppose you have an <a href=\"https:\/\/legalvision.co.uk\/employment\/responsibilities-pregnant-employees\/\">employee who is expecting a baby<\/a>. In that case, your employee <\/span>has the right<span style=\"font-weight: 400\"> to 52 weeks maternity leave, of which the first 26 weeks are termed \u2018ordinary maternity leave\u2019 and the remaining weeks are termed \u2018additional maternity leave\u2019. Y<\/span>our employee can take maternity<span style=\"font-weight: 400\"> leave as early as 11 weeks before the baby is due.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">When taking maternity leave, your employee may<\/span> have the right<span style=\"font-weight: 400\"> to tax and national insurance deductible pay. This includes:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"font-weight: 400\">90% of their average wage for the first six weeks; and<\/span><\/li><li><span style=\"font-weight: 400\">90% for the remaining weeks or \u00a3151.97 per week, depending upon which is lower<\/span>.<\/li><\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">If your business ceases trading, you<\/span> must still<span style=\"font-weight: 400\"> pay maternity leave.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">Furthermore, there are rules concerning when an employee can take their maternity leave. These include:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"font-weight: 400\">if the baby is born before maternity leave has started, it begins the day after the birth;<\/span><\/li><li><span style=\"font-weight: 400\">if your employee has an illness related to her pregnancy which causes her to be absent from work within four weeks of the due date of her baby (a week being Sunday to Saturday), maternity leave automatically begins; and<\/span><\/li><li>that you must take <span style=\"font-weight: 400\">maternity leave for a minimum of two weeks from the birth of the baby, or for factory workers, a minimum of four weeks.<\/span><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Paternity Leave<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">If you have an employee whose partner is expecting a baby, y<\/span>ou must pay them during <span style=\"font-weight: 400\">paternity leave. This applies to adoption and surrogacy too. Y<\/span>our employee can take this leave<span style=\"font-weight: 400\"> <\/span>as either<span style=\"font-weight: 400\"> one week of leave or two weeks one after the other.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">An employee <\/span>has the right<span style=\"font-weight: 400\"> to tax and national insurance deductible pay at 90% of the employee&#8217;s earnings or \u00a3151.97 per week, depending upon which amount is lower.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">There are rules concerning when an employee can take their paternity leave. For example:&nbsp;<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"font-weight: 400\">leave can begin on the date the baby is born or after the baby is due to be born &#8211; as agreed with you as the employer;<\/span><\/li><li><span style=\"font-weight: 400\">for employees adopting a baby, leave can start either on the date they<\/span> receive<span style=\"font-weight: 400\"> baby, the baby arrives in the UK, or a date they agree upon with you after either of those dates; and&nbsp;<\/span><\/li><li><span style=\"font-weight: 400\">leave cannot exceed 56 days after the baby is born, and where the baby is born before the due date, it must not exceed 56 days of the due date.<\/span><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Adoption Leave<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Employees are entitled to take up to 52 weeks of paid adoption leave where they are either adopting a child or having a child through surrogacy. These 52 weeks are divided into what is termed 26 weeks of \u2018Ordinary Adoption Leave\u2019 and 26 weeks of \u2018Additional Adoption Leave\u2019.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">You must pay your employee during the entire period of their adoption leave. The pay rate is 90% of their gross earnings for the first six weeks of leave and will remain at this or decrease to \u00a3151.97 depending on which figure is lower. Adoption pay is tax and national insurance deductible.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">There are some rules regarding when adoption leave can be taken. Adoption leave may begin:&nbsp;<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><span style=\"font-weight: 400\">14 days before the date which the child is expected to be placed with the employee; or<\/span><\/li><li><span style=\"font-weight: 400\">when the child starts to live with the employee;<\/span> or<\/li><li><span style=\"font-weight: 400\">the date the child has been matched with the employee; or<\/span><\/li><li><span style=\"font-weight: 400\">the date the child comes to the UK, or 28 days following this date; or<\/span><\/li><li><span style=\"font-weight: 400\">the date of birth of the child or the following day for surrogacy arrangements.<\/span><\/li><\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Shared Parental Leave<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\"><a href=\"https:\/\/legalvision.co.uk\/employment\/employment-statuses\/\">Shared Parental Leave<\/a> (SPL) is a form of leave taken by either parent consisting of the amount of any maternity or adoption leave not fully completed.&nbsp;<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">It must be taken within one year of the birth of the baby or the date of adoption.
