Unfair dismissal can be a result of the employer:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">&nbsp;not following the <a href=\"https:\/\/legalvision.co.uk\/employment\/employment-policies\/\">business disciplinary and dismissal procedures<\/a>; <\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">&nbsp;dismissing the employee without fair reason; or<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">&nbsp;giving reasons that do not justify dismissing the employee.<\/span><\/li>\n<\/ul>\n\n\n\n<p><span style=\"font-weight: 400\">As an employer, it is important to be aware of what can constitute an unfair dismissal to ensure that you only dismiss your employees with fair reason and fair procedure to avoid a potential claim at an employment tribunal for unfair dismissal. There are rules surrounding claims for unfair dismissal, and this includes who can and cannot make a claim.<\/span> <span style=\"font-weight: 400\">This article will explain:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">the different types of workers;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">whether a casual worker can claim unfair dismissal; and&nbsp;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">what the rules regarding this are.<\/span><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Three Key Types of Workers<\/span><\/h2>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Casual&nbsp;<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Casual workers carry out work for<\/span> you<span style=\"font-weight: 400\">, but not regularly. Therefore, y<\/span>ou<span style=\"font-weight: 400\"> a<\/span>re<span style=\"font-weight: 400\"> not obliged to offer a<\/span> casual employee<span style=\"font-weight: 400\"> work. Equally, a casual worker <\/span>does not have <span style=\"font-weight: 400\">to accept work when y<\/span>ou give it to them<span style=\"font-weight: 400\">, unlike if the work was through a<\/span> <span style=\"font-weight: 400\">contract. An employer may even use the word \u2018casual\u2019 in any contract they have with a casual worker.<\/span><\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Employee<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">Unlike casual workers, an employee is someone who carries out work for you based on an <a href=\"https:\/\/legalvision.co.uk\/employment\/reviewing-employment-contracts\/\">employee&#8217;s contract<\/a>. This contract provides additional rights to workers, such as the right to request flexible working and time off for emergencies. To be classed as an employee:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">y<\/span>ou must intend for that person to perform the<span style=\"font-weight: 400\"> work;<\/span><\/li>\n\n\n\n<li>you<span style=\"font-weight: 400\"> must sufficiently control the person; and<\/span><\/li>\n\n\n\n<li>there must be <span style=\"font-weight: 400\">\u201cmutuality of obligation\u201d between <\/span>you and the person<span style=\"font-weight: 400\">, which means that <\/span>you<span style=\"font-weight: 400\"> a<\/span>re<span style=\"font-weight: 400\"> obliged to give the person work, and they m<\/span>ust<span style=\"font-weight: 400\"> accept it.<\/span><\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Worker<\/span><\/h3>\n\n\n\n<p><span style=\"font-weight: 400\">As an employer, you may find that some people working for you may simply be <a href=\"https:\/\/legalvision.co.uk\/employment\/employment-statuses\/\">classed as \u2018workers\u2019<\/a>, which means that they have an arrangement to carry out work for you, possibly through a contract, and that they are rewarded for this. This is not an employee&#8217;s contract. They also have rights associated with their status such as the right to the National Minimum Wage and a statutory rest break. A worker may include:<\/span><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><span style=\"font-weight: 400\">agency workers;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">freelance workers;<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">zero-hour contract workers; and<\/span><\/li>\n\n\n\n<li><span style=\"font-weight: 400\">casual workers.<\/span><\/li>\n<\/ul>\n\n\n\n<h2 class=\"wp-block-heading\"><span style=\"font-weight: 400\">Unfair Dismissal<\/span><\/h2>\n\n\n\n<p><span style=\"font-weight: 400\">Whilst both employees and casual workers enjoy certain rights, there are some rights that casual workers <\/span>generally do not have the right to<span style=\"font-weight: 400\">. One of these is the protection against <a href=\"https:\/\/legalvision.co.uk\/employment\/summary-dismissal-legal\/\">unfair dismissal<\/a>, even if they have a substantial reason for raising this.&nbsp;<\/span><\/p>\n\n\n\n<div class=\"box box--icon box--info\">\n<p><span style=\"font-weight: 400\">Only those considered employees, including part-time and fixed-term employees, enjoy the right to protection from unfair dismissal where they have a fair reason.<\/span><\/p>\n<\/div>\n\n\n\n<p><span style=\"font-weight: 400\">However, whilst a casual worker does not have the right to claim for unfair dismissal, they can still appeal the dismissal through their employer&#8217;s appeals procedure where they feel the dismissal was unfair. In addition, the casual worker may involve a trade union if they belong to one.<\/span><\/p>\n\n\n\n<p><span style=\"font-weight: 400\">If an employer does not have an appeal procedure, the casual worker may decide to informally chat to their employer to see if there are any options for reinstating their work.<\/span><\/p>\n\n\n\n<div class=\"box box--icon box--info\">\n<p><span style=\"font-weight: 400\">Whilst casual workers do not have a right to claim unfair dismissal employers should note that there are instances where it is not particularly clear whether a casual worker is, in fact, a casual worker or actually an employee. This is because there is no exact legal meaning of the term \u2018casual worker\u2019.&nbsp;<\/span><\/p>\n<\/div>\n\n\n\n<p><span style=\"font-weight: 400\">If the dismissed person is an employee, they may have grounds to claim unfair dismissal. In some instances, you may deem an employee under an \u2018umbrella contract\u2019 to be casual. This is when the casual worker has been working for the employer through a series of mini contracts, yet when having a break between those contracts, an overriding contract has been found between the casual worker and the employer.
